टीडीएस, स्व-आकलन कर, अग्रिम कर: AY2018-19 के लिए आपकी आयकर रिटर्न में इन्हें कैसे संभालें

टीडीएस, एडवांस टैक्स और सेल्फ-आकलन कर के रूप में करदाताओं से कर एकत्र किए जाते हैं। आप इन्हें अपने आईटीआर में कैसे रिपोर्ट करेंगे?

असाधारण लोगों को हमेशा कुछ हासिल करने का आग्रह होता है। इन सभ्य समाजों में और आयकर विभागों द्वारा इन लोगों की आवश्यकता होती है क्योंकि वे जितनी कमाई करते हैं, उतना अधिक कर वे भुगतान करेंगे। आयकर पर आयकर कर के माध्यम से आयकर पर भुगतान किया जाता है। आय अर्जित करने की प्रक्रिया के दौरान सरकार को करों का भुगतान किया जाता है और इस तंत्र को '   Pay-As-You-Earn’  ' कहा जाता है।

टीडीएस, एडवांस टैक्स और सेल्फ-आकलन कर के रूप में करदाताओं से कर एकत्र किए जाते हैं। क्या आपने कभी सोचा है कि ये तीन अवधारणाएं क्या हैं?

स्रोत पर कर कटौती

पहली अवधारणा स्रोत या टीडीएस पर कर कटौती की गई है जिसे आप पहले से ही शुरुआती वर्षों में अनुभव कर चुके हैं। इस अवधारणा को करदाता को देय राशि से एक हिस्से को रोकने के लिए भुगतानकर्ता (यानी, नियोक्ता, बैंक, किरायेदार, आदि) की आवश्यकता होती है और इसे केंद्र सरकार के साथ जमा करनी पड़ती है। सरकार द्वारा कटौती और जमा किए गए ऐसे करों का श्रेय देय (करदाता) को उनकी कुल कर देयता के खिलाफ अनुमति है। कर की रोकथाम के सबूत के रूप में, भुगतानकर्ता भुगतानकर्ता को टीडीएस प्रमाण पत्र जारी करते हैं, यानी फॉर्म 16, फॉर्म 16 ए इत्यादि।

अग्रिम कर

अगली अवधारणा 'एडवांस टैक्स' है। यदि करदाता की अनुमानित कर देयता 10,000 रुपये या उससे अधिक है, तो उसे वित्तीय वर्ष के दौरान चार किश्तों में अग्रिम कर का भुगतान करना होगा, यानि 15%, 45%, 75% और 100% अग्रिम कर देयता का भुगतान करना होगा 15 जून, 15 सितंबर, 15 दिसंबर और 15 मार्च को या उससे पहले। हालांकि, एक निवासी वरिष्ठ नागरिक जो व्यवसाय या पेशे से आय नहीं लेता है, वह अग्रिम कर का भुगतान करने के लिए उत्तरदायी नहीं है, भले ही उसकी अनुमानित कर देयता 10,000 रुपये से अधिक हो। धारा 44 एडी / 44 एडीए के तहत अनुमानित कराधान योजना का चयन करने वाले करदाता 15 मार्च तक एक ही किश्त में अग्रिम कर का 100% भुगतान कर सकते हैं। 31 मार्च के दिन या उससे पहले अग्रिम कर के माध्यम से भुगतान की गई किसी भी राशि को उस दिन समाप्त होने वाले वित्तीय वर्ष के दौरान अग्रिम कर के रूप में भी माना जाता है।

आत्म-आकलन कर

यदि टीडीएस और अग्रिम कर की राशि को ध्यान में रखकर देय कर देयता बनी हुई है, तो उसे स्व-आकलन कर के माध्यम से भुगतान करना होगा। आत्म-मूल्यांकन कर का आकलन वर्ष 1 अप्रैल से वित्तीय वर्ष के अंत के बाद भुगतान किया जा सकता है।

फॉर्म 26 एएस एक टैक्स पासबुक है जिसमें एक करदाता यह सत्यापित कर सकता है कि उसके द्वारा या उसके द्वारा भुगतान किए गए कर वास्तव में अपनी कर पासबुक में उपलब्ध हैं ताकि रिटर्न दाखिल करने के समय उसके क्रेडिट का दावा किया जा सके। किसी भी विसंगति के मामले में, करदाता को यह सुनिश्चित करना चाहिए कि टीडीएस रिटर्न में कटौतीकर्ता द्वारा उनके विवरण का सही ढंग से उल्लेख किया गया हो या उसने टैक्स चालान में अपना विवरण दायर किया है, जो अग्रिम कर या आत्म-मूल्यांकन कर के भुगतान के लिए उपयोग किया जाता है

सभी आयकर रिटर्न फॉर्म (आईटीआर 1 में फॉर्म आईटीआर 1) में अनुसूची आईटी, अनुसूची टीडीएस और अनुसूची टीसीएस शामिल है, जिसके लिए करदाता को अग्रिम कर, आत्म-मूल्यांकन कर, टीडीएस और टीसीएस के विवरण भरने की आवश्यकता होती है।

अग्रिम कर और आत्म-मूल्यांकन कर भुगतान का विवरण अनुसूची आईटी में बीएसआर कोड बैंक, जमा की तारीख, चालान की सीरियल संख्या और कर भुगतान की राशि के बारे में जानकारी के साथ दिखाया जाना है। बीएसआर कोड आरबीआई द्वारा बैंकों को आवंटित 7 अंकों वाला कोड है। यह कोड बैंक की प्रत्येक व्यक्तिगत शाखा के लिए अद्वितीय है। यह कोड सरकार के साथ कर जमा करने के लिए उपयोग किए गए चालान में पाया जा सकता है।

टीडीएस से संबंधित सारणी अनुसूची टीडीएस में फॉर्म 16, फॉर्म 16 ए, फॉर्म 16 बी और फॉर्म 16 सी में उपलब्ध जानकारी के साथ भरनी है। आम तौर पर, इन रूपों के बीच कोई अंतर नहीं होता है और 26 एएस बनाते हैं क्योंकि ये टीडीएस प्रमाण पत्र भी निशान से डाउनलोड किए जाते हैं। हालांकि, ऐसे मामले हो सकते हैं जहां टीडीएस प्रमाण पत्र जारी करने के बाद, डीडक्टर / पेयर ने अपने टीडीएस रिटर्न में संशोधन किया है जिसके परिणामस्वरूप टीडीएस प्रमाण पत्र और फॉर्म 26 एएस के बीच अंतर हो सकता है।

इस प्रकार, करदाता के लिए किसी भी मेल नहीं खाते से बचने के लिए आईटीआर दाखिल करने से पहले टीडीएस प्रमाण पत्र के साथ फॉर्म 26 एएस की तुलना करने के लिए सलाह दी जाती है। फॉर्म 16 नियोक्ता द्वारा वेतन से कटौती कर दिखाते हुए कर्मचारी को जारी किया जाता है। वेतन के अलावा किसी भी भुगतान से कटौती के लिए भुगतानकर्ता द्वारा फॉर्म 16 ए जारी किया जाता है। एक अचल संपत्ति की खरीद के मामले में, खरीदार सकल राशि के 1% की दर से कर कटौती करने के लिए उत्तरदायी है यदि संपत्ति का कुल बिक्री विचार 50 लाख या उससे अधिक है। फॉर्म 16 बी में कर की रोकथाम के लिए टीडीएस प्रमाण पत्र जारी किया गया है। किराया भुगतान से उसके द्वारा कर कटौती की गई है तो किरायेदार द्वारा फॉर्म 16 सी जारी किया जाता है। एक किरायेदार धारा 1 9 4-आई या धारा 1 9 4-आईबी के तहत कर घटा सकता है। यदि टीडीएस प्रमाण पत्र फॉर्म 16 ए में है, तो उसे तालिका 2 में सूचित किया जाएगा और यदि फॉर्म 16 सी जारी किया गया है, तो उसे तालिका 3 में रिपोर्ट किया जाएगा। एकल कटौती के लिए एकाधिक प्रविष्टियों को भरने की कोई आवश्यकता नहीं है। इसे समेकित आंकड़े के रूप में दिखाया जा सकता है।

अनुसूची टीसीएस में टीसीएस के विवरण की रिपोर्ट करने के लिए तालिका आम तौर पर व्यावसायिक संस्थाओं के मामले में लागू होती है। हालांकि, यह तालिका लागू हो जाती है जब एक करदाता 10 लाख रुपये से अधिक मूल्य के किसी भी मोटर वाहन (पुराने या नए) खरीदता है। इस मामले में, विक्रेता को बिक्री विचार के 1% की दर से टीसीएस एकत्र करना होगा और इसे केंद्र सरकार के साथ जमा करना होगा। इस तरह के टीसीएस विवरण इस कार्यक्रम में दिखाए जाने चाहिए।

आईटीआर 2 और आईटीआर 3 में टीडीएस अनुसूची करदाता को टीडीएस राशि आगे ले जाने की इजाजत देता है यदि संबंधित आय चालू वर्ष में कर योग्य नहीं है। बैंक लेखांकन की संचय विधि का पालन करते हैं जिसके लिए बैंकों को 31 मार्च तक एफडी पर अर्जित ब्याज की राशि से कर कटौती की आवश्यकता होती है। इस तरह के ब्याज को वर्ष के दौरान करदाता को भुगतान नहीं किया जा सकता है, लेकिन करों का कटौती और बैंक द्वारा जमा किया गया है सरकार। यदि ऐसा है, तो करदाता अगले वर्ष टीडीएस राशि अग्रेषित कर सकता है अगर वह नकद आधार पर अपनी आय पर कर चुकाने की पेशकश करता है। इसका मतलब है कि जब वह वास्तव में आय प्राप्त करता है तो वह कर चुकाएगा। यह विकल्प वेतन आय और किराये की आय के लिए उपलब्ध नहीं है।

इन शेड्यूल को मैन्युअल रूप से दायर किया जा सकता है या लॉग-इन के बाद ई-फाइलिंग खाते से प्री-दायर एक्सएमएल डाउनलोड करके। एक्सेल या जावा रिटर्न तैयारी उपयोगिता, शेड्यूल आईटी, अनुसूची टीडीएस और अनुसूची टीसीएस में अपलोड होने पर प्री-भरे एक्सएमएल स्वचालित रूप से दायर किया जाएगा।  फॉर्म 26 एएस के साथ इन शेड्यूल की ऑटो सिंकिंग की अनुमति देते हैं। यह सलाह दी जाती है कि रिपोर्टिंग में किसी भी त्रुटि से बचने के लिए मैन्युअल रूप से इन शेड्यूल को भरना न पड़े। इन कार्यक्रमों को भरने के लिए करदाताओं को प्री-दायर एक्सएमएल का सहारा लेना चाहिए।

ITC claim of invoice from 2017-18 after September 2018




Section 16 of Central Goods and Service Tax Act, 2017 ("the CGST Act, 2017") specify certain conditions to claim input tax credit against any inward supply one of which is the last date to claim ITC against any taxable invoice.
Subsection 4 of section 16 of the CGST Act, 2017 states that last date for claiming input tax credit against any taxable invoice or debit note is earliest of due date of return filed under section 39 [GSTR -3] or the date of furnishing annual return (31st December). Now, literal interpretation of the said provision is that Input tax credit against any tax invoice pertaining to FY 17-18 can be claimed up to the last date of filing GSTR -3 of September month of FY 18-19 or annual return of FY 17 -18 whichever is earlier.
Relevant extract of section is reproduced here for quick reference;
(4) A registered person shall not be entitled to take input tax credit in respect of any invoice or debit note for supply of goods or services or both after the due date of furnishing of the return under section 39 for the month of September following the end of financial year to which such invoice or invoice relating to such debit note pertains or furnishing of the relevant annual return, whichever is earlier.
However, what twist the simple provision in present scenario is the deferment of return in form GSTR – 3 by Noti the cation No. 58/2017 – Central Tax dated November 15th, 2017 and till date no due date is been notified by the government.
As the last date to claim ITC against invoice pertaining to FY 17-18 is earliest of;
  • Due date of GSTR - 3 of September 2018
  • Date of furnishing of annual return of FY 2017-18; and in absence of due date of GSTR - 3 it could be argued that input tax credit can be availed even after the month of September but before the date of filing of annual return.
Also, one contradictory view could also be taken here that in absence of GSTR - 3 due dates of return in Form GSTR-3B shall be considered for the purpose of last date. However, said view is not legally correct as GSTR-3B is not a substitute of GSTR - 3, same is substantiated by taking reference from below mentioned rules of Central Goods and services Rules, 2017 ("the CGST Rules")
Rule 61(5) of the CGST Rules states that whenever the last date of filing GSTR -1 and  GSTR -2 shall be extended in such circumstances return shall be furnished in FORM GSTR-3B.
Further, through Notification no. 17/2017 dated July 27th, 2017 the word “return in Form GSTR -3B is lieu to Form GSTR-3 may be furnished in such manner and subject to such conditions as may be notified by the commissioner” had been deleted by substituting 61(5) with new sub-rule 5 & 6 to rule 61.
Said rule is reproduced here for the quick reference of the reader ;
[(5) Where the time limit for furnishing of details in FORM GSTR-1 under section 37 and in FORM GSTR-2 under section 38 has been extended and the circumstances so warrant, the Commissioner may, by notification, [specify the manner and conditions subject to which the] 38 return shall be furnished in FORM GSTR-3B electronically through the common portal, either directly or through a Facilitation Centre notified by the Commissioner.
From the detailed analysis of section 16(4) of CGST Act read with rule 61(5) of CGST Rules, it can be concluded that return in FORM GSTR 3B is not a supplement of return under FORM GSTR -3.
Thus ITC of invoice pertaining to FY 17-18 can even be claimed after the month of September and can be claimed upto the notified due date of GSTR – 3 of FY 18-19 or the annual return of FY 17-18 whichever is earlier.
Further, one more thing which should be read simultaneously with section 16(4) is the language of section 34 ("Credit note and debit note") wherein, it is stated that details of credit note can, at last, be furnished  in return for the month of September following the end of Financial year or annual return whichever is earlier i.e. no any specific reference of section 37 (GSTR -1)  or 39 (GSTR -3)   is provided in section 34. But, the same is provided in section 16(4).
Meaning thereby, the law has made some distinction between the two provisions. However, the benefit of both the provision will result a decrease in output tax liability of the taxpayer.
Hence, till the time the due date for the filing of the GSTR-3 is being not prescribed than  ITC of invoice pertaining to FY 17-18 can even be claimed after the month of September and can be claimed upto the notified due date of GSTR – 3 of FY 18-19 or annual return of FY 17-18 whichever is earlier and the same shall not be in contrary to the provision of CGST Act, 2017

सितंबर 2018 के बाद 2017-18 से चालान का आईटीसी दावा

केन्द्रीय सामान और सेवा कर अधिनियम, 2017 ("सीजीएसटी अधिनियम, 2017") की धारा 16 किसी भी आंतरिक आपूर्ति के खिलाफ इनपुट कर क्रेडिट का दावा करने के लिए कुछ शर्तों को निर्दिष्ट करती है, जिसमें से किसी भी कर योग्य चालान के खिलाफ आईटीसी का दावा करने की आखिरी तारीख है।

सीजीएसटी अधिनियम, 2017 की धारा 16 के उपधारा 4 में कहा गया है कि किसी भी कर योग्य चालान या डेबिट नोट के खिलाफ इनपुट कर क्रेडिट का दावा करने की अंतिम तिथि धारा 39 [जीस्ट्र -3] के तहत दायर की गई वापसी की देय तिथि या वार्षिक रिटर्न प्रस्तुत करने की तारीख है (31 दिसंबर)। अब, प्रावधान प्रावधान की शाब्दिक व्याख्या यह है कि वित्त वर्ष 17-18 से संबंधित किसी भी कर चालान के खिलाफ इनपुट कर क्रेडिट का दावा वित्त वर्ष 18-19 के सितंबर महीने के जीएसटी -3 दर्ज करने या वित्त वर्ष 17 की वार्षिक वापसी की अंतिम तिथि तक किया जा सकता है। -18 जो भी पहले हो।

त्वरित संदर्भ के लिए खंड का प्रासंगिक निकास यहां पुन: उत्पन्न किया गया है;

(4) एक पंजीकृत व्यक्ति सितंबर माह के लिए धारा 3 9 के तहत रिटर्न प्रस्तुत करने की देय तिथि के बाद माल या सेवाओं की आपूर्ति के लिए किसी भी चालान या डेबिट नोट के संबंध में इनपुट कर क्रेडिट लेने के हकदार नहीं होगा। वित्तीय वर्ष का अंत जिसमें इस तरह के चालान नोट से संबंधित चालान या चालान संबंधित वार्षिक रिटर्न से संबंधित या प्रस्तुत करना, जो भी पहले हो।

हालांकि, मौजूदा परिदृश्य में सरल प्रावधान क्या है, फॉर्म जीएसटी -3 में वापसी का स्थगन, नेशन द्वारा संविधान सं। 58/2017 - 15 नवंबर, 2017 के केंद्रीय कर और आज तक कोई देय तिथि सरकार द्वारा अधिसूचित नहीं की गई है।

वित्त वर्ष 17-18 से संबंधित चालान के खिलाफ आईटीसी का दावा करने की आखिरी तारीख के रूप में जल्द से जल्द है;

जीएसटी की देय तिथि - सितंबर 2018 के 3
वित्त वर्ष 2017-18 की वार्षिक वापसी की तिथि; और जीएसटी -3 की देय तिथि की अनुपस्थिति में यह तर्क दिया जा सकता है कि सितंबर के महीने के बाद भी इनपुट कर क्रेडिट का लाभ उठाया जा सकता है लेकिन वार्षिक रिटर्न दाखिल करने की तारीख से पहले।
इसके अलावा, यहां एक विरोधाभासी विचार भी लिया जा सकता है कि जीएसटी की अनुपस्थिति में - फॉर्म जीएसटी -3 बी में वापसी की देय तारीखों को अंतिम तिथि के उद्देश्य के लिए माना जाएगा। हालांकि, कहा गया है कि विचार कानूनी रूप से सही नहीं है क्योंकि जीएसटी -3 बी जीएसटी -3 का विकल्प नहीं है, वही केंद्रीय सामान और सेवाओं के नियमों, 2017 ("सीजीएसटी नियम") के नीचे दिए गए नियमों से संदर्भ लेते हुए प्रमाणित किया जाता है।

सीजीएसटी नियमों के नियम 61 (5) में कहा गया है कि जब भी जीएसटी -1 और जीएसटी -2 दाखिल करने की आखिरी तारीख ऐसी परिस्थितियों में विस्तारित की जाएगी तो फॉर्म एफएमएम जीएसटी -3 बी में प्रस्तुत किया जाएगा।

आगे, अधिसूचना संख्या के माध्यम से। 27 जुलाई, 2017 के 17/2017 शब्द "फॉर्म जीएसटी -3 बी में वापसी फॉर्म जीएसटी -3 के लिए है, इस तरह से प्रस्तुत की जा सकती है और कमिश्नर द्वारा अधिसूचित की जाने वाली शर्तों के अधीन" 61 को प्रतिस्थापित करके हटा दिया गया था ( 5) 61 के नियम के लिए नए उप-नियम 5 और 6 के साथ।

कहा गया है कि पाठक के त्वरित संदर्भ के लिए यहां नियम पुन: उत्पन्न किया गया है;

[(5) धारा 37 के तहत फॉर्म जीएसटी -1 में फॉर्म प्रस्तुत करने के लिए समय सीमा और धारा 38 के तहत फॉर्म जीएसटी -2 में विस्तारित किया गया है और परिस्थितियां इतनी वारंट हैं, आयुक्त, अधिसूचना द्वारा, [तरीके और निर्दिष्ट करें शर्तों के अधीन] 38 वापसी सामान्य पोर्टल के माध्यम से इलेक्ट्रॉनिक रूप से FORM GSTR-3B में प्रस्तुत की जाएगी, या तो सीधे या आयुक्त द्वारा अधिसूचित सुविधा केंद्र के माध्यम से।

CGST अधिनियम की धारा 61 (5) के साथ पढ़े गए सीजीएसटी अधिनियम की धारा 16 (4) के विस्तृत विश्लेषण से, यह निष्कर्ष निकाला जा सकता है कि फॉर्म जीएसटी 3 बी में वापसी फॉर्म जीएसटी -3 के तहत रिटर्न का पूरक नहीं है।

इस प्रकार वित्त वर्ष 17-18 से संबंधित चालान के आईटीसी पर भी सितंबर के महीने के बाद दावा किया जा सकता है और वित्त वर्ष 18-19 के जीएसटी -3 की अधिसूचित देय तिथि या एफवाई 17-18 की वार्षिक वापसी जो भी पहले हो, पर दावा किया जा सकता है।

इसके अलावा, धारा 16 (4) के साथ एक साथ पढ़ी जाने वाली एक और चीज धारा 34 ("क्रेडिट नोट और डेबिट नोट") की भाषा है, जिसमें कहा गया है कि क्रेडिट नोट का विवरण, अंत में, बदले में प्रस्तुत किया जा सकता है वित्तीय वर्ष या वार्षिक रिटर्न के अंत के बाद सितंबर के महीने के लिए जो भी पहले हो यानी धारा 37 (जीस्ट्र -1) या 39 (जीएसटी -3) का कोई विशिष्ट संदर्भ धारा 34 में प्रदान नहीं किया गया है। लेकिन, यह भी प्रदान किया जाता है धारा 16 (4)।

इस प्रकार, कानून ने दो प्रावधानों के बीच कुछ अंतर बना दिया है। हालांकि, दोनों प्रावधानों के लाभ से करदाता की आउटपुट कर देयता में कमी आएगी।

इसलिए, जब तक वित्त वर्ष 17-18 से संबंधित चालान के आईटीसी की तुलना में जीएसटी -3 की फाइलिंग की देय तिथि निर्धारित नहीं की जा रही है, तब भी सितंबर के महीने के बाद दावा किया जा सकता है और जीएसटी की अधिसूचित देय तिथि तक दावा किया जा सकता है - वित्त वर्ष 18-19 का 3 या वित्त वर्ष 17-18 की वार्षिक वापसी जो भी पहले हो और वह सीजीएसटी अधिनियम, 2017 के प्रावधान के विपरीत नहीं होगी।

इनकम टैक्स रिफंड के बारे में जानें ये जरूरी बातें



टैक्स डिडक्टेड ऐट सोर्स (TDS) आपके इनकम के सोर्स से इनकम टैक्स कलेक्ट करने का एक तरीका है। यह कई तरह के इनकम पर लागू होता है। मसलन, कंपनी सैलरी, बैंक FD पर मिलने वाला इंट्रेस्ट, फ्रीलांसरों को दिया जानेवाला पेमेंट, वकीलों को दी जानेवाली फी, इत्यादि। 

लेकिन TDS इनकम टैक्स डिपार्टमेंट को आपके द्वारा दिया जानेवाला फाइनल टैक्स अमाउंट नहीं है, बल्कि आपकी वास्तविक टैक्स देनदारी इससे अधिक या कम हो सकती है। इसलिए, यदि एक वित्त वर्ष के दौरान काटा गया कुल TDS, आपकी वास्तविक टैक्स देनदारी से अधिक है तो आप कुल TDS में से अपनी टैक्स देनदारी को घटाने के बाद शेष TDS अमाउंट को वापस करने का अनुरोध कर सकते हैं। उदाहरण के लिए, यदि एक फाइनैंशल इयर के दौरान आपका कुल TDS 80,000 रु. था, लेकिन इनकम टैक्स रिटर्न फाइल करते समय पता चलता है कि आपकी वास्तविक टैक्स देनदारी सिर्फ 30,000 रु. है तो आप 50,000 रु. का TDS रिफंड पाने के हकदार होंगे। 

TDS रिफंड के लिए क्लेम करने का तरीका 
TDS रिफंड के लिए क्लेम करने के लिए आपको संबंधित आकलन वर्ष (AY) में अपना इनकम टैक्स रिटर्न (ITR) फाइल करना पड़ेगा। बिना जुर्माना दिए ITR फाइल करने की आखिरी तारीख आम तौर पर संबंधित आकलन वर्ष की 31 जुलाई होती है (AY पिछले फाइनैंशल वर्ष के ठीक बाद वाला फाइनैंशल वर्ष होता है, उदाहरण के लिए FY 2018-19, FY 2017-18 का आकलन वर्ष है।) 
ITR फाइल करते समय आपके द्वारा दी गई जानकारी के आधार पर स्क्रीन पर ‘रिफंड’ कॉलम के नीचे रिफंड की रकम दिखाई देगी। इनकम टैक्स डिपार्टमेंट आपके ITR को प्रॉसेस करने, उसकी सटीकता की जांच करने और उसे स्वीकार कर लेने के बाद आपको सूचित करेगा। टैक्सपेयर को धारा 143(I) के अंतर्गत ‘टैक्स कैलकुलेशन इनकम टैक्स डिपार्टमेंट के साथ मैच हो गया है, ‘टैक्स कैलकुलेशन इनकम टैक्स डिपार्टमेंट के साथ मैच नहीं कर रहा है’ या ‘कैलकुलेशन इनकम टैक्स डिपार्टमेंट के साथ मैच हो गया है और रिफंड का क्लेम स्वीकार कर लिया गया है’ जैसी सूचनाएं दी जाती हैं। 

यदि आप ऑनलाइन अपना ITR फाइल करते हैं और आपने इनकम टैक्स डिपार्टमेंट के साथ अपना मोबाइल नंबर रजिस्टर कर लिया है तो आपको SMS के माध्यम से भी ITR की प्रॉसेसिंग के बारे में सूचना मिल सकती है। आपको बैंक अकाउंट का डीटेल देने के लिए कहा जाएगा जिसमें आप रिफंड लेना चाहते हैं यदि आप ऑनलाइन रिटर्न फाइल कर रहे हैं। इनकम टैक्स डिपार्टमेंट के लिए मूल्यांकन चक्र के समापन के बाद रिफंड की रकम आपके अकाउंट में जमा हो जाएगी। ऑफलाइन रिफंड के लिए टैक्सपेयर के नाम से एक चेक जारी किया जाएगा। 
TDS रिफंड पर इंट्रेस्ट 
यदि टैक्सपेयर संबंधित मूल्यांकन वर्ष की 31 जुलाई से पहले रिफंड के लिए क्लेम करते हुए ITR फाइल करता है तो टैक्सपेयर संबंधित आकलन वर्ष के 1 अप्रैल से लेकर रिफंड ग्रांट होने की तारीख तक की अवधि के लिए रिफंड अमाउंट पर इंट्रेस्ट प्राप्त करने का हकदार होता है। यदि रिटर्न संबंधित आकलन वर्ष की 31 जुलाई के बाद फाइल किया गया है तो इंट्रेस्ट का कैलकुलेशन ITR फाइल करने की तारीख से लेकर रिफंड ग्रांट होने की तारीख तक की अवधि के लिए किया जाता है। वर्तमान में रिफंड अमाउंट पर 6% सालाना की दर से इंट्ररेस्ट दिया जाता है। रिफंड पर मिलनेवाले इंट्रेस्ट पर टैक्स लगता है और उसे उस फाइनैंशल इयर के लिए टैक्सपेयर के टोटल इनकम में जोड़ दिया जाता है जिस फाइनैंशल वर्ष में इंट्रेस्ट प्राप्त हुआ है।

Benefits of Availing Presumptive Taxation Scheme

i) No requirement of maintaining books of accounts

ii)  8% of the Gross receipt or total turnover treated as income in case of business by Individual, HUF or Partnership (in case of amount received through account payee cheque / draft or through digital transaction only 6% is treated as income) having turnover less than 2 Crores.

Important provisions relating to cash transactions under the Income tax act, 1961

To evade black money and to discourage cash transactions, the Government of India is taking various steps time to time. In this regard, the Income Tax Act, 1961 is amended and provided with disallowances and stringent penal provisions for various types of cash transactions. Let us briefly focus on some of such provisions here.
Section 40A(3): Disallowance of Expenses incurred in Cash:
Sec. 40A(3): Where the assessee incurs any expenditure in respect of which payment or aggregate of payments made in a day in excess of Rs. 10,000/- (w.e.f. A.Y. 2018-19) otherwise than by Account-payee cheque/Bank Draft/use of Electronic Clearing System through a bank account, 100% of such payment shall be disallowed.
Section 40A(3A): Deemed Income of Subsequent year in which payment is made:
Where an allowance has been made in the assessment for any year in respect of any liability incurred by the assessee for any expenditure and subsequently during any previous year (hereinafter referred to as subsequent year) the assessee makes payment in respect thereof, otherwise than by Account-payee cheque/Bank Draft/use of Electronic Clearing System through a bank account, the payment so made shall be deemed to be the profits and gains of business or profession and accordingly chargeable to income-tax as income of the subsequent year if the payment or aggregate of payments made to a person in a day, exceeds Rs.10,000/-.
Exceptions to Section 40A(3) and 40A(3A):
Provided that no disallowance shall be made and no payment shall be deemed to be the profits and gains of business or profession under subsection (3) and this subsection where a payment or aggregate of payments made to a person in a day, otherwise than by Account-payee cheque/Bank Draft/use of Electronic Clearing System through a bank account, exceeds Rs.10,000/-, in such cases and under such circumstances as may be prescribed in Rule 6DD, having regard to the nature and extent of banking facilities available, considerations of business expediency and other relevant factors.
Provided further that in the case of payment made for plying, hiring or leasing goods carriages, the provisions of subsection (3) and (3A) shall have effect as if for Rs.10,000/-, the amount substituted for Rs.35,000/-. (Which means if payment is being made for plying, hiring or leasing goods carriages, then Limit is Rs.35000/-, instead of Rs.10000/-)
In respect of Capital Expenditure (Fixed Assets):
Where an assessee incurs any expenditure for acquisition of any asset in respect which a payment or aggregate of payments made to a person in a day, otherwise than by an Account-payee cheque/Bank Draft/use of Electronic Clearing System through a bank account, exceeds Rs.10,000/-, such expenditure shall be ignored for the purposes of determination of actual cost of such asset. (It means no depreciation benefit will be available on such amount)
Amendment by Finance bill 2018:
Provision of Section 40A(3) and 40A(3A) will be applicable to Charitable and Religious trusts for the purpose of determination of the application of fund. (Which means payments made by violating of these provisions is not treated/allowed as an application of fund).
Section 269SS:  Mode of Taking or Accepting Certain Loans, Deposits and Specified Sum:
No person shall take or accept from any other person any loan or deposit or specified sum (Specified sum means any sum of money receivable whether as advance or otherwise, in relation to transfer of an immovable property, whether or not the transfer takes place) of Rs. 20,000 or more otherwise than by way of an account payee cheque or an account payee draft or use of electronic clearing system through a bank account. The limit of Rs. 20,000 will also apply to a case even if on the date of taking or accepting such loan or deposit, any loan or deposit taken or accepted earlier by such person from such depositor is remaining unpaid and such unpaid amount along with the loan or deposit to be accepted, exceeds the aforesaid limit.
Provided that the provisions of this section shall not apply to-
any loan or deposit or specified sum taken or accepted from or any loan or deposit or specified sum taken or accepted by-
(a) Government;
(b) any banking company, post office savings bank or co-operative bank;
(c) any corporation established by a central, state or provincial Act;
(d) any Government company as defined in clause (45) of section 2 of the Companies Act, 2013;
(e) such other institution, association or body or class of institutions, associations or bodies which the Central Government may, by notification in the Official Gazette, specify.
Provided further that the provisions of this section shall not apply to any loan or deposit or specified sum, where the person from whom the loan or deposit or specified sum is taken or accepted and the person by whom the loan or deposit or specified sum is taken or accepted, are both having agricultural income and neither of them has any income chargeable to tax under the Income Tax Act, 1961.
For example: If A has a balance of a loan of Rs.19500/- from B. Now in this case A cannot take loan in excess of Rs.499/- from B except with an account payee cheque or account payee bank Draft or use of electronic clearing system through a bank account.
In case of violation of the above provision, penalty u/s. 271D of Income Tax Act 1961 shall be levied equivalent to the amount of such loan or deposit or specified sum, so taken or accepted.
Section 269T: Mode of Repayment of Certain Loans or Deposits:
Section 269T of the Income Tax Act provides that any branch of a banking company or a cooperative society, firm or other person shall not repay any loan or deposit otherwise than by an account payee cheque or account payee bank draft or use of electronic clearing system through a bank account, who has made the loan or deposit or paid the specified advance (Specified advance means any sum of money in the nature of advance, by whatever name called in relation to transfer of an immovable property, whether or not transfer takes place), if
(a) The amount of the loan or deposit or specified advance together with the interest, if any, is Rs.20,000/- or more, or
(b) The aggregate amount of loans or deposits or specified advance held by such person, either in his own name or jointly with other person on the date of such repayment together with the interest, if any, is Rs.20,000/- or more.
Provided that where the repayment is by a branch of a banking company or co-operative bank, such repayment may also be made by crediting the amount of such loan or deposit to the savings bank account or the current account, if any, with such branch of the person to whom such loan or deposit has to be repaid.
Provided further that the provisions of this section shall not apply to- 
Repayment of any loan or deposit or specified sum is taken or accepted from -
(a) Government;
(b) any banking company, post office savings bank or co-operative bank;
(c) any corporation established by a central, state or provincial Act;
(d) any Government company as defined in clause (45) of section 2 of the Companies Act, 2013;
(e) such other institution, association or body or class of institutions, associations or bodies which the Central Government may, by notification in the Official Gazette, specify.
For example if A is having loan of Rs 30000 outstanding to B, then he cannot repay such loan in cash to B.
In case of violation of above provision, penalty u/s. Section 271E of Income Tax Act 1961 shall be levied equivalent to the amount of such loan or deposit repaid.
Section 269ST: Mode of Undertaking Transactions: (w.e.f. 01.04.2017)
Section 269ST provides - No person shall receive an amount of Two Lakh rupees or more-
(a) in aggregate from a person in a day; or
(b) in respect of a single transaction; or
(c) in respect of transactions relating to one event or occasion from a person,
otherwise than by an account payee cheque or an account payee bank draft or use of electronic clearing system through a bank account:
Provided that the provisions of this section shall not apply to-
(i) any receipt by-
(a) Government;
(b) any banking company, post office savings bank or co-operative bank;
(ii) transactions of the nature referred to in section 269SS;
(iii) such other persons or class of persons or receipts, which the Central Government may, by notification in the Official Gazette, specify.
Example: 1
A made credit sale of Rs.2,50,000 to B for Rs. 1,00,000 and Rs.1,50,000 on two different dates, and if payment received on single day then the Section 269ST is attracted since “aggregate payment received is more than Rs.2,00,000/-”.
Example: 2
A made credit sale of Rs. 2,00,000 to B and two cash payments of RS. 1,00,000 per day are made by B to A on two different dates. Section 269ST is attracted as Rs.2,00,000 cash limit is reached “in respect of a single transaction”.
Example: 3
Suppose a caterer takes order for Convocation Function and received Rs. 10,00,000 in cash from his customer and gives item-wise bill for various services and each bill doesn’t exceed Rs. 2,00,000 and Rs. 10,00,000 cash is received on different dates and cash received on any one day is less than Rs. 2,00,000. This splitting of bills and splitting of payments day-wise will not help as all these payments are “in respect of transactions relating to one event or occasion from a person”.

With regards to repayment of loan received by NBFCs or HFCs, the CBDT has vide circular No.22 of 2017 dated 03/07/2017 clarified that in respect of receipt in the nature of repayment of loan by NBFCs or HFCs, the receipt of one instalment of loan repayment in respect of a loan shall constitute a ‘single transaction’ as specified in clause (b) of section 269ST of the Act and all the instalments paid for a loan shall not be aggregated for the purposes of determining applicability of the provisions section 269ST.
In case of violation of provision of this section penalty u/s. 271DA shall be levied for a sum equal to the amount of such receipt.
No TCS on Cash Sales after insertion of Section 269ST:
TCS (Tax Collected at Source) on Cash Sales of Goods or offering any service for Cash exceeding Rs.2,00,000/- which was introduced in F.Y. 2016-17 was removed from F.Y. 2017-18 due to insertion of Section 269ST.
Also, TCS on cash sales of Bullion and Jewellery removed from the F.Y. 2017-18.

ITR filing for FY 2017-18: Common mistakes that may get you a tax notice

A taxpayer should start the ITR filing process by choosing the right form. Income tax experts warn against claiming deductions one is not eligible for

: The due date for filing of income tax return (ITR) for the financial year 2017-18 (assessment year 2018-19) is 31 July 2018. In a rush to meet the deadline, many taxpayers might end up making mistakes which might fetch them a notice from income tax authorities. “Though mistakes committed in ITR filing can be rectified by filing revised return, it would require extra time and efforts,” said Vishal Raheja, assistant manager at Taxmann, an online publisher on taxation and corporate laws.

Income tax return for the assessment year 2018-19 can be revised by 31 March 2019.

The income tax department has notified seven ITR forms for filing of return for FY 2017-18. ITR filing process starts from choosing the correct form, which depends on the nature of income and the status of the taxpayers. Some of the common mistakes that you should avoid committing during ITR filing:

(1) “Don’t presume that if tax has already been paid, you don’t need to file the return,” says Vishal Raheja of Taxmann. If you are resident in India, irrespective of tax liability, you have to file ITR if taxable income exceeds basic exemption limit, which is ₹ 3 lakh for senior citizens (age above 60 years), ₹ 5 lakh for super-senior citizens (above 80 years) and ₹ 2.5 lakh for all other individual taxpayers.

(2) If you choose the wrong ITR form, you may not report the complete information and the income tax department can issue a notice for under-reporting income.

3) However small the income may be, you should report it in our ITR, say tax experts. “Income tax department gets regular information from banks and financial institutions about your transactions which are reconciled with your ITR. If some tax has been deducted from your income but you don’t report the corresponding income in ITR, you might get a notice,” says Raheja.
(4) If you have changed jobs during the year, you have to report income earned from all the employers in your tax return. Further, “if any income of your minor child or spouse is required to be clubbed with your income then you have to report it,” he adds.

(5) Tax experts warn against claiming deductions in ITR for which you are not eligible for. “Some taxpayers claim fake deductions or inflate existing deductions to reduce their income tax liability or to claim refunds,” says Raheja.

(6) A taxpayer should also ensure that ITR data is in sync with that of Form 26AS. In case of any discrepancy, the income tax department could issue notice, seeking explanation for discrepancies in the figures of income or TDS appearing in Form 26AS and income tax return. Form 26AS is basically a consolidated tax credit statement that has all details of various taxes deducted on your income at source. Form 26AS can be accessed from the tax department’s website.
7) If you are filing ITR belatedly, then make sure that pay late filing fees before filing of ITR, say tax experts. “A late filing fees of ₹ 5,000 shall be charged if the return is filed between 01.08.2018 and 31.12.2018. The fees shall be ₹ 10,000 if return is filed between 01.01.2019 and 31.03.2019. The late filing shall be ₹ 1,000 for small taxpayers whose taxable income is up to ₹ 5 lakh,” says Raheja.

(8) If you fail to either e-verify your ITR or post it to Centralized Processing Centre (CPC) of the income tax department in Bengaluru, return will be treated as an invalid return. While filing ITR you are asked to digitally sign or e-verify it. In case, you do not e-verify your return, you can sign the acknowledgement copy of ITR and post it to CPC, Bangaluru. The acknowledgement has to be sent within 120 days of filing of the return.

धारा 40 ए (3 ए): बाद के वर्ष की अनुमानित आय जिसमें भुगतान किया जाता है:

जहां किसी भी व्यय के लिए किसी भी व्यय के लिए निर्धारिती द्वारा किए गए किसी भी उत्तरदायित्व के संबंध में किसी भी वर्ष के निर्धारण में किसी भत्ते के लिए और किसी भी पिछले वर्ष के दौरान बाद में भत्ता दिया गया है (इसके बाद उपसे के रूप में संदर्भित किया गया है ...

पूंजी व्यय (निश्चित संपत्ति) के संबंध में:

जहां एक निर्धारिती किसी भी संपत्ति के अधिग्रहण के लिए किसी भी परिसंपत्ति के अधिग्रहण के लिए कोई व्यय करता है, जिसके संबंध में किसी व्यक्ति को भुगतान किए गए भुगतान या कुल भुगतान, अन्यथा खाताधारक चेक / बैंक ड्राफ्ट / बैंक खाते के माध्यम से इलेक्ट्रॉनिक क्लियरिंग सिस्टम का उपयोग, 10,000 / - से अधिक, इस तरह के परिसंपत्ति निर्धारण की वर्तमान लागत के प्रयोजनों के लिए इस तरह के व्यय को नजरअंदाज कर दिया जाएगा। (इसका मतलब है कि इस तरह की राशि पर कोई मूल्यह्रास लाभ उपलब्ध नहीं होगा)

वित्त बिल 2018 में संशोधन:

धारा 40 ए (3) और 40 ए (3 ए) का प्रावधान फंड के आवेदन के निर्धारण के उद्देश्य से चैरिटेबल और धार्मिक ट्रस्ट पर लागू होगा। (जिसका अर्थ है कि इन प्रावधानों का उल्लंघन करके किए गए भुगतान को फंड के आवेदन के रूप में इलाज / अनुमति नहीं दी जाती है)।

धारा 26 9एसएस: कुछ ऋण, जमा और निर्दिष्ट राशि स्वीकार करने या स्वीकार करने का तरीका:

कोई भी व्यक्ति किसी अन्य व्यक्ति से कोई ऋण या जमा या निर्दिष्ट राशि नहीं लेता या स्वीकार नहीं करेगा (निर्दिष्ट राशि का अर्थ है ...

बशर्ते कि इस धारा के प्रावधान किसी भी ऋण या जमा या निर्दिष्ट राशि पर लागू नहीं होंगे, जहां निर्दिष्ट ऋण या ऋण जमा किया गया है या स्वीकार किया गया है और जिस व्यक्ति द्वारा ऋण या जमा या निर्दिष्ट राशि ली जाती है या स्वीकार किए जाते हैं, दोनों में कृषि आय है और न ही आयकर अधिनियम, 1 9 61 के तहत कर के लिए कोई आय लागू है।
