Seeks to amend CGST Rules (Fourth Amendment) in order to allow opting Composition Scheme for FY 2020-21 till 30.06.2020 and to allow cumulative application of condition in rule 36(4).

 Amendment in CGST Rules (Fourth Amendment) – Key Changes

The CGST (Fourth Amendment) Rules, 2020 were introduced to provide relief to taxpayers amid the COVID-19 pandemic. The key amendments included:

1. Extension for Opting Composition Scheme for FY 2020-21

  • Taxpayers were allowed to opt for the Composition Scheme till 30th June 2020 for the financial year 2020-21.
  • Normally, the due date for opting for the Composition Scheme is 31st March of the preceding financial year, but this was extended due to the pandemic.
  • The filing of Form CMP-02 was required by 30th June 2020.

2. Cumulative Application of Rule 36(4) for ITC Restriction

  • Rule 36(4) of CGST Rules, 2017 restricts ITC availment to the extent of ITC reflected in GSTR-2A/2B.
  • Due to COVID-19, businesses faced issues with vendor compliance, so the condition was relaxed for the period Feb 2020 to Aug 2020.
  • Cumulative application of Rule 36(4) was allowed, meaning taxpayers could adjust ITC restrictions in September 2020’s GSTR-3B instead of applying them month-wise.

सीजीएसटी नियमों (चौथा संशोधन) में बदलाव – मुख्य बिंदु

सीजीएसटी (चौथा संशोधन) नियम, 2020 को COVID-19 महामारी के दौरान करदाताओं को राहत देने के लिए लाया गया था। इस संशोधन के प्रमुख बदलाव निम्नलिखित हैं:

1. वित्तीय वर्ष 2020-21 के लिए संरचना योजना (Composition Scheme) चुनने की तिथि बढ़ाई गई

  • करदाताओं को 30 जून 2020 तक कंपोजिशन स्कीम चुनने की अनुमति दी गई।
  • आमतौर पर, कंपोजिशन स्कीम के लिए आवेदन करने की अंतिम तिथि 31 मार्च होती है, लेकिन महामारी के कारण इसे बढ़ाकर 30 जून 2020 कर दिया गया।
  • करदाताओं को Form CMP-02 30 जून 2020 तक फाइल करना आवश्यक था।

2. नियम 36(4) की शर्तों को सामूहिक रूप से लागू करने की अनुमति

  • CGST नियम 36(4) के अनुसार, ITC केवल GSTR-2A/2B में प्रतिबिंबित (reflect) ITC तक सीमित होता है।
  • महामारी के कारण कई व्यापारियों के सप्लायर्स ने समय पर रिटर्न दाखिल नहीं किया, जिससे ITC लेने में परेशानी हुई।
  • इसलिए, फरवरी 2020 से अगस्त 2020 तक के लिए नियम 36(4) की शर्तों को सामूहिक रूप से (Cumulatively) लागू करने की छूट दी गई।
  • करदाताओं को इन महीनों के लिए ITC सितंबर 2020 की GSTR-3B में समायोजित करने की अनुमति दी गई।

संशोधन का प्रभाव

✅ छोटे व्यापारियों को राहत, जिन्होंने कंपोजिशन स्कीम का विकल्प नहीं चुना था।
✅ ITC समायोजन में लचीलापन, जिससे महामारी के कारण आईटीसी में हुई देरी को समायोजित किया जा सका।
✅ अनुपालन में आसानी, क्योंकि अब हर महीने ITC प्रतिबंध लागू करने के बजाय, सितंबर 2020 में समग्र रूप से इसे ठीक किया जा सकता था।
